Services, Immigrant Rights, and Education Network (SIREN) Condemns Trump’s Proposed Rules Attacking Low-Income Immigrants 

Community members and allies urged to submit public comment

Today, the Trump Administration officially published its proposed rule to drastically limit the ability for immigrants to get a green card or change their visas, particularly those who are low-income or use various public benefits. The proposed rule would expand the definition of “public charge” to factor in use of various public benefits such as food and nutrition assistance, certain health care benefits, and housing and rental assistance. It would also expand factors that could weigh negatively in public charge determinations including being low-income, applying for an immigration application fee waiver, limited English proficient or having certain health conditions, among others. If approved, this could be heavily considered when denying an individual a green card. It is important to note that this rule has not yet gone into effect and immigrants who are currently eligible for those programs can continue to use them. The public has an opportunity to comment opposing these rules until December 10.

The following is a statement from Maricela Gutiérrez, Executive Director of Services, Immigrant Rights, and Education Network (SIREN):

“It is unconscionable that the Trump Administration is proposing to punish low-income immigrant communities by essentially forcing them to choose between getting support with health care, food, and housing and getting a green card. Getting help to simply survive should not be a factor in whether someone can get permanent residency. It is important for the community to know that this rule is not yet adopted or in effect. Right now, we have the opportunity to fight it. We urge immigrant community members, organizations, businesses, elected officials, and allies to submit public comment by December 10 opposing this proposed rule.”

Individuals can sign up to submit their own public comment and will receive sample messages and resources. Help support our efforts to reach as many community members as possible so they can submit their comment opposing this rule by making a donation to SIREN today.

Miembros de la comunidad y aliados instados a presentar comentarios públicos

Hoy, la Administración de Trump publicó oficialmente su regla propuesta para limitar drásticamente la capacidad de los inmigrantes para obtener una tarjeta verde o cambiar sus visas, en particular aquellos que tienen bajos ingresos o usan diversos beneficios públicos. La norma propuesta ampliaría la definición de "cargo público" para tener en cuenta el uso de diversos beneficios públicos, como asistencia alimentaria y nutricional, ciertos beneficios de atención médica y asistencia para vivienda y alquiler. También expandiría los factores que podrían influir negativamente en las determinaciones de cargos públicos, entre los que se incluyen bajos ingresos, un dominio limitado del inglés o ciertas condiciones de salud, entre otras. Si se aprueba, esto podría considerarse seriamente cuando se deniega a una persona una tarjeta verde. Es importante tener en cuenta que esta regla aún no ha entrado en vigencia y los inmigrantes que actualmente son elegibles para esos programas pueden continuar usándolos. El público tiene la oportunidad de comentar oponiéndose a estas reglas hasta el 10 de diciembre.

La siguiente es una declaración de Maricela Gutiérrez, Directora Ejecutiva de Servicios, Derechos de Inmigrantes y Red de Educación (SIREN):

“Es inconcebible que la Administración Trump esté proponiendo castigar a las comunidades de inmigrantes de bajos ingresos esencialmente forzándolos a elegir entre recibir apoyo con atención médica, comida y vivienda, y obtener una tarjeta verde. Obtener ayuda para simplemente sobrevivir no debe ser un factor para que alguien pueda obtener la residencia permanente. Es importante que la comunidad sepa que esta regla aún no se ha adoptado o está vigente. En este momento, tenemos la oportunidad de luchar contra él. Instamos a los miembros de la comunidad inmigrante, organizaciones, empresas, funcionarios electos y aliados a enviar comentarios públicos antes del 10 de diciembre que se opongan a esta regla propuesta."

La Ley de la Verdad requiere que un cuerpo legislativo local realice un foro comunitario anualmente si la policía local permite el acceso de la migra a cualquier individuo. Desde 2015, el Sheriff Mims ha trabajado estrechamente con la migra para deportar a más de 500 personas. Necesitamos miembros de la comunidad para hacer preguntas y exigir transparencia sobre el enredo entre la migra y el Departamento del Sheriff del Condado de Fresno. ¡Debemos responsabilizar a Sherff Mims y eliminar a ICE de Fresno!

The Truth Act requires a local legislative body to hold a community forum annually if local law enforcement allows ICE access to any individual. Since 2015, Fresno County Sheriff Mims has worked closely with ICE to deport over 500 people. We need community members to attend the forum and ask key questions and demand transparency about the entanglement between ICE and the Fresno County Sheriff's Department. El Instituto de Verano de Liberacion para jóvenes es un programa diseñado para empoderar a los jóvenes inmigrantes con conocimiento acerca de como apoyar las políticas y leyes, herramientas de compromiso cívico y de desarrollo de campañas para construir un movimiento para la justicia social.Los jóvenes participarán en discusiones críticas sobre los sistemas de opresión y privilegios, acceso a la educación, LGBTQ, injusticia racial, desigualdad económica, estrategias de resolución de problemas, y mucho más. 
*Participantes recibiran una beca*

Los participantes obtendrán habilidades de política de inmigración, defensa de la deportación, planificación de campañas, compromiso cívico, asuntos sociales, organización comunitaria, y tendrán la oportunidad de asistir a eventos de justicia social y defensa, oficinas legislativas para reunirse e interactuar con funcionarios electos y líderes comunitarios. 
¡El instituto tiene como objetivo capacitar a los jóvenes a entender problemas sociales y aprender a como apoyar el cambio social!

Foro Comunitario sobre Inmigración con la Patrulla de Caminos de California



San José, CA - La actual administración federal ha creado miedo entre nuestra comunidad inmigrante. Los miembros de la comunidad temen caer en manos de la migra  cuando se acercan a las escuelas de sus hijos, clínicas de salud comunitarias o agentes de la ley. SIREN con la Patrulla de Caminos de California (CHP) quiere informar a la comunidad inmigrante de las políticas actuales de la agencia en lo que se refiere a los inmigrantes. Existe una distinción entre la policía local y los funcionarios del estado de California y es importante que nuestra comunidad tome conciencia de la diferencia.
El martes 6 de febrero de 2018, los líderes inmigrantes de SIREN organizará un foro comunitario con CHP en la Escuela Primaria Los Árboles en San José. El foro brindará a la comunidad la oportunidad de aprender y hacer preguntas sobre las políticas de CHP relacionadas con la inmigración y cómo se relacionan con los inmigrantes. Los oficiales de CHP también compartirán información sobre el papel de CHP como agencia de aplicación de la ley.
El foro comenzará con una mesa redonda seguida de preguntas y respuestas.
Los Líderes Inmigrantes de SIREN estarán disponibles para entrevistas con los medios.

Immigrant Community Forum with California Highway Patrol


San José, CA -- The current federal administration has created fear among our immigrant community. Local community members are fearful of falling in the hands of Immigration, Customs, Enforcement (ICE)  when approaching their children’s schools, community health clinics or law enforcement officers. SIREN with the California Highway Patrol (CHP) wants to inform the immigrant community of the agency’s current policies as it relates to immigrants. There is a distinction between local law enforcement and California State officers and it is important that our community becomes aware of the difference. 

On Tuesday, February 6, 2018, SIREN immigrant leaders will host a community forum with CHP at Los Arboles Elementary School in San Jose. The forum will provide the community the opportunity to learn and ask questions about CHP policies relating  to immigration and how they deal with immigrants. Officers from CHP will also share information about CHP’s role as a law enforcement agency. 

The forum will begin with panel discussion followed by Q&A. 

SIREN’s Immigrant Grassroots Leaders will be available for media interviews.

Immigration Information Session

Given President-Elect Trump’s rhetoric against the immigrant community during the campaign and uncertainty of the details of his immigration plan SIREN strongly cautions applicants against applying for or renewing DACA. While we do not know with complete certainty, President-Elect Trump has stated that he intends to undo President Obama’s executive action programs, including the DACA 2012 program. We certainly understand the benefits that accompany a DACA grant are great and that many have made the courageous decision to seek DACA to provide greater security for yourselves and your families. Yet, at this time, we recommend individuals not to apply given the uncertainty regarding the program.

Ultimately, the decision is up to you. In that vein, we are providing the attached information from the Immigrant Legal Resource Center for you to make an informed decision about how to move forward. We will respect your decision to not apply for DACA, as well as your decision to apply for DACA if that is what you decide.  We remain willing to assist you in completing the DACA application packet and will provide you mailing instructions to send the packet. Regardless of how you decide to move forward, we strongly encourage you to consult with a reputable immigration attorney or nonprofit legal services agency about any permanent immigration relief options available to you.

We also encourage you and your family to be informed about your rights in the event for an immigration enforcement action.
