SIREN Statement on DACA Trial Court Decision
San Jose, July 20 – On July 16, 2021, a federal judge in Texas ruled that the Deferred Action for Childhood Arrival Program (DACA) was illegal, and barred DHS from approving new applicants to the program. Though the decision is likely to be appealed in courts, the emotional toll taken on the undocumented community by these constant attacks to their stability and livelihoods is incalculable. We demand a permanent solution from Congress to protect our undocumented community so that we may live our lives with peace and dignity. The political fervor raised in the previous year to manifest change brought Democrats to power in the Executive branch, and gave them a majority in Congress – the time is now to use that political power. Anything short of comprehensive immigration reform for all 11 million undocumented individuals in the U.S is a political failure.
“Judge Hanen’s ruling against DACA underscores the urgency to deliver a path to citizenship for all immigrants. Regardless of the political party in power, immigrant communities continue to face legal barriers, all while trying to survive a global pandemic that disproportionately wrought havoc on working-class immigrant families,” said Maricela Gutierrez, Executive Director of SIREN. “If even 1 person in this country gets left out of immigration reform, that’s too many people we’re leaving at the mercy of a predatory, vicious, and broken immigration system.”
Our team of legal service providers are connecting with first time applicants and assessing their case. Applicants who have been left out of the program by the federal ruling from Texas are being offered an intake assessment to see if they are eligible for any other form of relief.

SIREN Condena Decisión DACA por Juez de Tejas, Exige Protecciones Permanentes Para Toda la Comunidad Indocumentada
San Jose, Julio 20 – Un juez federal de Tejas anuncio su decisión el viernes, Julio 16 en el caso de Texas v U.S que el programa de DACA es ilegal bajo las leyes de los Estados Unidos. En su opinión de 77 paginas, el juez Andrew Hanen prohibió aprobación de solicitudes de DACA
para applicantes de primera ves, mientras que los actuales beneficiarios de DACA no serán afectados y podrán continuar con sus trámites de renovación. Es probable que la decisión sera peleada en las cortes, pero la devastacion emocional que sufre la comunidad indocumentada por estos ataques continuos es incalculable. SIREN exige que Congreso tome accion para proveir una solucion permanente para todos los indocumentados en este pais. Todos merecemosvivir nuestras vidas con paz y dignidad, algo que es imposible mientras que ICE y el gobierno federal sigua deteniendo y separando a nuestra comunidad. Los Democratas en Congreso tienen el poder politico necesario para cambiar todas nuestras vidas, necesitamos accion ahora.
“La decisión del juez Hanen contra DACA nos demuestra porque tenemos tanta urgencia para reforma migratoria. Soluciones temporales solo nos hacen mas daño, lo que necesita nuestra comunidad trabajadora es reforma migratoria para todos los 11 millones en el país. Es lo menos que podemos hacer para la comunidad indocumentada que a sufrido ataques legales continuos durante una pandemia global en la que fueron excluidos de alivio,” dijo Maricela Gutiérrez, directora ejecutiva de SIREN.
