Services, Immigrant Rights, and Education Network (SIREN) Applauds Ruling Halting TPS Termination
Urges Congress to pass legislation providing TPS holders permanent protection
Yesterday, U.S. District Court Judge Chen granted a preliminary injunction temporarily halting the termination of Temporary Protected Status (TPS) for individuals from El Salvador, Haiti, Nicaragua, and Sudan while the case continues in court. In this ruling, related to a lawsuit filed by TPS recipients, the judge found that there would be irreparable harm and hardship to individuals and their families if they were deported, the country would suffer great economic harm, the Trump Administration failed to follow proper procedures in its decisions to terminate TPS, and there were serious questions about whether the Department of Homeland Security made its decision based on racism against non-white and non-European immigrants. The Trump Administration will have 15 days to develop a plan to implement the injunction and advocates will provide information to current TPS holders on what process will be set up by the federal government to avoid deportation.
The following is a statement from Maricela Gutiérrez, Executive Director of SIREN:
“The ruling to temporarily halt the termination of TPS for those from El Salvador, Haiti, Nicaragua, and Sudan is a tremendous victory. It will allow hundreds of thousands of community members to breathe a sigh a relief. Without this injunction, mass deportations of TPS holders would have started as early as next month. In his decision, Judge Chen rightly found what we all knew: there is ample evidence that the Trump Administration was motivated by racism and they did not follow proper procedures in making their decisions. But we also know that this victory is only temporary. The only solution to fully prevent the deportation of TPS holders is for Congress to pass already introduced legislation that provides them with permanent protection. While we celebrate this win, the fight is not over and we call upon our federal legislators to provide a path to permanent residency.”

Insta al Congreso a aprobar legislación que proporcione a los titulares de TPS protección permanente
Ayer, el Juez del Tribunal de Distrito de los EE. UU. Chen otorgó un recurso judicial preliminar que detiene temporalmente la terminación del Estatus de Protección Temporal (TPS) para individuos de El Salvador, Haití, Nicaragua y Sudán mientras el caso continúa en los tribunales. En esta decisión, relacionada con una demanda presentada por los destinatarios de TPS, el juez determinó que habría daños irreparables y dificultades para las personas y sus familias si fueran deportados, el país sufriría un gran daño económico, la Administración de Trump no siguió los procedimientos apropiados en sus decisiones de terminar el TPS, y hubo serias dudas sobre si el Departamento de Seguridad Nacional tomó una decisión basada en el racismo contra los inmigrantes no blancos y no europeos. La Administración de Trump tendrá 15 días para desarrollar un plan para implementar el mandato judicial y los defensores proporcionarán información a los actuales titulares de TPS sobre qué proceso establecerá el gobierno federal para evitar la deportación.

“La decisión de detener temporalmente la terminación de TPS para aquellos de El Salvador, Haití, Nicaragua y Sudán es una tremenda victoria. Permitirá que cientos de miles de miembros de la comunidad respiren un suspiro de alivio. Sin esta orden, las deportaciones masivas de los titulares de TPS habrían comenzado tan pronto como el próximo mes. En su decisión, el juez Chen acertadamente encontró lo que todos sabíamos: existe amplia evidencia de que la administración de Trump fue motivada por el racismo y no siguieron los procedimientos adecuados para tomar sus decisiones. Pero también sabemos que esta victoria es sólo temporal. La única solución para prevenir completamente la deportación de los titulares de TPS es que el Congreso apruebe la legislación ya introducida que les proporciona protección permanente. Mientras celebramos esta victoria, la lucha no ha terminado y hacemos un llamado a nuestros legisladores federales para que proporcionen un camino hacia la residencia permanente."
