Statement: SIREN Celebrates Success of Community Efforts to Shutdown Camp Roberts

SIREN Celebrates Fed's Decision not to House Unaccompanied Minors at Toxic Camp Roberts Military Base - a Huge Win for the Immigrants’ Rights Community

   Today, SIREN and community advocates from the #ShutDownCampRoberts Coalition are celebrating the news that, after months of community-led advocacy and resistance, the department of Health and Human Services has announced they are no longer considering Camp Roberts military base in San Miguel, CA as a site to detain unaccompanied minors. 

SIREN expresses its deepest sympathy to the children seeking care, compassion and relief from economic and natural disaster at the southern border. As such, we have consistently advocated against the proposed use of Camp Roberts to house up to 5,000 unaccompanied minors on the grounds that a military base with active military members and a history of toxic waste disposal is  a completely inappropriate location for housing children. SIREN condemns the use of any facility that deprives an individual of the freedom of movement and contributes to the U.S’s damning legacy of family separation. We continue to advocate for a better way to exercise our duty to support the international community in times of need. 

“We celebrate today because we don’t have to worry about the danger and damage that 5,000 children would have surely faced at Camp Roberts. The fight continues until our demands are met. SIREN and our partners will continue to oppose child detention - at Camp Roberts and anywhere else. There is a better solution for these children that is not rooted in the immoral and unnecessary expansion of the carceral system,” said Maricela Gutierrez, Executive Director of SIREN.

We call on our local representatives to urge the Biden administration to take the following steps:

• Rescind provisions in the Title 42 Health Code that expel asylum-seekers and result in institutionalized family separation

• End the use of large-scale ‘intake’ and ‘influx’ for holding children, especially those that exist on military bases

• Implement policies and protocols that expedite the reunification of children with trusted family members, relatives, and/or caregivers

• Abolish all detention centers, jails and prisons

Immigrant Rights Organization Praises SCOTUS Ruling on Census Citizenship Question

San Jose, CA - Today, the United States Supreme Court has effectively prevented, for now, an attempt by the Trump administration to add a citizenship question to the 2020 Census, and will be sending it back to the lower court. Immigrant rights organization Services, Immigrant Rights and Education Network (SIREN) is calling the decision victory, and will continue to organize and provide community education to increase participation among immigrants and refugee families to empower their neighborhoods with vita community resources, as well as congressional representation and redistricting.

“We exposed Trump for exactly what he is, a fear-mongering and power-hungry leader,” said SIREN Executive Director Maricela Gutierrez. “The inclusion of a citizenship question on the Census was never about collecting government data. It was about stoking fear in immigrant communities and denying us a right to visibility and representation. Our communities can feel empowered that we count and that we matter.”

In response to today’s ruling, SIREN will be hosting a press conference today at 1pm at its office located at 1415 Koll Circle, Suite 108, San Jose, 95112. Please come out and be part of the community as we rise up and elevate our community voices.

The U.S. census takes place every 10 years and the data collected impact the future of our communities. The data help determine how more than $800 billion in federal resources will be distributed, including where schools, roads and hospitals are built, as well as providing the basis for funding for other essential programs and services. The census is also used to decide congressional representation, as well as used to decide redistricting on federal, state, and local levels of government.

Over the past few days, the Trump Administration has continued to cause panic, fear, and confusion within the immigrant community with reports of potential increased immigration enforcement and possible delays in those efforts. This is part of the federal government’s ongoing tactics to terrorize community members, families and playing political games with their lives. Regardless of statements coming from the White House, it is vital community members remember they have constitutional rights when they are approached by ICE no matter their immigration status. We urge community members to exercise their rights, prepare your family if a loved one is arrested by ICE, and seek legal support if those facing deportation.

Applauds Santa Clara County for Standing with Immigrant Community

Yesterday, in an historic unanimous vote, the Santa Clara County Board of Supervisors affirmed our County’s long standing values of not working with ICE and respecting the due process rights of all immigrants. Over the past few months, the County had been considering avenues that allowed cooperation and communication with ICE. As a result of intensive mobilization and advocacy by the immigrant community and allies spearheaded by Forum for Immigrant Rights and Empowerment (FIRE) Coalition, co-chaired by SIREN, our elected officials did not expand the ability for the County’s entanglement with ICE. All of the Supervisors voted in favor of a policy proposal presented by County Administration, informed by various stakeholders including the immigrant community. This policy reiterates that our County will not honor detainers or notification questions from ICE and reaffirms our policy to require judicial warrants for transfers.The Board also directed that stakeholders, including immigration experts, be involved in the development of transfer protocols to ensure that the Sheriff and Chief of Corrections abide by judicial warrant standards. 

The following is a statement from Maricela Gutiérrez, Executive Director of SIREN:

“Despite efforts to have our County entangled with ICE, the community has prevailed and we are thrilled by yesterday’s historic unanimous vote. The community made its voice heard loud and clear that Santa Clara County should not be working hand-in-glove with ICE - particularly under this Administration. The County heard the community’s deep concerns about the increased fear and mistrust that immigrants will have with local government, due process violations that result in notifying ICE when an individual is released from County custody, and the potential liability that it opens up our County to. We appreciate the thoughtful process that the County Executive and County Counsel’s offices went through developing its proposal. And we thank Supervisor Wasserman for introducing the motion to support the proposal and each of the Board members for their votes yesterday reaffirming our longstanding values of standing with the immigrant community. Most importantly, we thank the immigrant community for urging our County to do the Our County has long led in the nation on this and yesterday’s vote makes it abundantly clear that when the community calls for it, we can continue to do so.”

Aplaude el condado de Santa Clara por estar de pie con la comunidad de inmigrantes

Ayer, en un histórico voto unánime, la Junta de Supervisores del Condado de Santa Clara afirmó los valores de larga data de nuestro Condado de no trabajar con la Migra sin respetar los derechos de debido proceso de todos los inmigrantes. En los últimos meses, el Condado había estado considerando vías que permitían la cooperación y la comunicación con ICE. Como resultado de la intensa movilización y defensa por parte de la comunidad de inmigrantes y aliados encabezados por la Coalición del Foro por los Derechos de los Inmigrantes y el Empoderamiento (FIRE), copresidido por SIREN, nuestros funcionarios electos no ampliaron la capacidad para el enredo del Condado con la Migra. Todos los Supervisores votaron a favor de una propuesta de política presentada por la Administración del Condado, informada por varias partes interesadas, incluida la comunidad inmigrante. Esta política reitera que nuestro Condado no cumplirá con los retenidos o las preguntas de notificación de la Migra y reafirma nuestra política de exigir órdenes judiciales para las transferencias. La Junta también ordenó que las partes interesadas, incluidos los expertos en inmigración, participen en el desarrollo de protocolos de transferencia para garantizar que el Sheriff y el Jefe de Correcciones acatan las normas de orden judicial.

House of Representatives must pass clean legislation during floor vote

Yesterday, the House Judiciary Committee successfully passed the DREAM Act and the  American Promise Act . These bills would provide a pathway to citizenship for DACA-recipients, DREAMers, and recipients of Temporary Protected Status (TPS) and Deferred Enforced Departure (DED). The Committee also passed legislation protecting Venezuelans in the United States. During the committee vote, members were able to successfully defeat various anti-immigrant amendments proposed on these bills.

The following is a statement from Maricela Gutiérrez, Executive Director of SIREN:

“Ever since Trump has taken office, the lives of DREAMers, DACA-recipients, and TPS holders have been plagued by uncertainty about their ability to remain in the country as cases have been litigated in the courts. Congress has long had the power to provide permanent protections to immigrants. Yesterday’s votes by the House Judiciary Committee to advance these two pieces of legislation means that we have overcome a major hurdle in making that a reality. We continue to remain concerned with provisions in the legislation that could bar individuals for certain criminal offenses and will continue to fight for clean legislation as it makes its way to the House floor. ”

La Cámara de Representantes debe aprobar una legislación limpia durante la votación en el piso.

Ayer, el Comité Judicial de la Cámara aprobó con éxito el acto de DREAM y el acto American Promise. Estos proyectos de ley proporcionarían un camino hacia la ciudadanía para los destinatarios de DACA, los DREAMers y los beneficiarios del estado de protección temporal (TPS) y la salida forzada diferida (DED). El comité también aprobó una legislación que protege a los Venezolanos en los Estados Unidos. Durante la votación del comité, los miembros pudieron derrotar exitosamente varias enmiendas anti-inmigrantes propuestas en estos proyectos de ley.

Congress must be bold in fighting against Trump’s racist agenda

Today, Trump declared a national emergency to create a border wall. Despite members of Congress on both sides of the aisle caving into his demands for funding for immigration enforcement and detention yesterday, he continues to advance his white supremacist agenda to further militarize the border, dehumanize immigrants and refugees, and play up the politics of racism and fear. By making this emergency declaration, he is openly undermining Congress and will immediately face challenges in court.

The following is a statement from Maricela Gutiérrez, Executive Director of SIREN:

“The true emergencies are the rampant detention and deportation of immigrants, turning back of asylum-seekers, and the lives of DACA-recipients and TPS holders being in limbo since this Administration took office.  It is disturbing, yet not surprising, that Trump is willing to take unilateral and unconstitutional steps to get his racist wall - especially after Congress abandoned the immigrant community and shamefully handed him more money for detention beds, immigration agents, and border barriers yesterday. While we look forward to supporting efforts to challenge Trump’s declaration in court, it is imperative that our members of Congress show courage and remain accountable to their constituents by taking steps to reverse this dangerous declaration and completely defunding ICE and CBP. ”

Services, Immigrant Rights, and Education Network (SIREN) Condemns Trump’s Threat to Declare National Emergency Trump has manufactured the border crisis and Congress must oppose funding for DHS

Today, Trump is expected to make a potential declaration of a national emergency at the border. In an attempt to circumvent Congress and as a result of the federal government shutdown that he created, Trump is attempting to force the creation of a border wall. By making such an emergency declaration, Trump would be undermining Congress and walking on very questionable legal ground.

The following is a statement from Maricela Gutiérrez, Executive Director of Services, Immigrant Rights, and Education Network (SIREN):

“The only crisis that exists at the border is the unconscionable detention, abuses, and deaths of individuals arriving at the border. Trump and his administration are responsible for the atrocities against asylum-seekers and immigrants coming to this country denying them of basic rights and human dignity. He is also responsible for the current federal government shutdown which he is using as justification for the racist wall and declaration of a national emergency. By separating children from their families and denying legal avenues to apply for asylum, the Trump administration created a humanitarian crisis at the border. Our country should be welcoming those coming to the border - not falsely declaring a national emergency to build a wall.”

“La única crisis que existe en la frontera es la detención desmedida, los abusos y las muertes de personas que llegan a la frontera. Immigrant Rights Group to Host Press Conference Celebrating Voter Turnout Among Immigrants

San Jose, CA -- Immigrant and refugee rights organization, Services, Immigrant Rights and Education Network (SIREN) will be hosting a press conference Wednesday, November 7 at 11:00am to celebrate the voter turnout among immigrants and youth in Northern California and the Central Valley, and the difference they made in the passing of key state ballot propositions and local measures.

Since September, SIREN’s civic engagement team, made up of immigrants and youth, made over 130,000 calls and 3,000 texts to immigrant voters in multiple counties throughout the Bay Area and Central Valley in Spanish and Vietnamese.

“In this election, we showed up to vote in massive numbers in our region and the state, our campaign was about engaging with immigrant and youth voters and building community power with them” said SIREN’s Executive Director, Maricela Gutiérrez.  “We will keep our movement going by organizing this new voting bloc, and continue to fight for immigrant and refugee rights.”

Speakers will include immigrants and young people who voted in their first election, and who are left out of the voting process but who helped lead the voter engagement campaign.

Services, Immigrant Rights, and Education Network (SIREN) Condemns Trump’s Proposed Rules Attacking Low-Income Immigrants 

Community members and allies urged to submit public comment

Today, the Trump Administration officially published its proposed rule to drastically limit the ability for immigrants to get a green card or change their visas, particularly those who are low-income or use various public benefits. The proposed rule would expand the definition of “public charge” to factor in use of various public benefits such as food and nutrition assistance, certain health care benefits, and housing and rental assistance. It would also expand factors that could weigh negatively in public charge determinations including being low-income, applying for an immigration application fee waiver, limited English proficient or having certain health conditions, among others. If approved, this could be heavily considered when denying an individual a green card. It is important to note that this rule has not yet gone into effect and immigrants who are currently eligible for those programs can continue to use them. The public has an opportunity to comment opposing these rules until December 10.

The following is a statement from Maricela Gutiérrez, Executive Director of Services, Immigrant Rights, and Education Network (SIREN):

“It is unconscionable that the Trump Administration is proposing to punish low-income immigrant communities by essentially forcing them to choose between getting support with health care, food, and housing and getting a green card. Getting help to simply survive should not be a factor in whether someone can get permanent residency. It is important for the community to know that this rule is not yet adopted or in effect. Right now, we have the opportunity to fight it. We urge immigrant community members, organizations, businesses, elected officials, and allies to submit public comment by December 10 opposing this proposed rule.”

Miembros de la comunidad y aliados instados a presentar comentarios públicos

Hoy, la Administración de Trump publicó oficialmente su regla propuesta para limitar drásticamente la capacidad de los inmigrantes para obtener una tarjeta verde o cambiar sus visas, en particular aquellos que tienen bajos ingresos o usan diversos beneficios públicos. La norma propuesta ampliaría la definición de "cargo público" para tener en cuenta el uso de diversos beneficios públicos, como asistencia alimentaria y nutricional, ciertos beneficios de atención médica y asistencia para vivienda y alquiler. También expandiría los factores que podrían influir negativamente en las determinaciones de cargos públicos, entre los que se incluyen bajos ingresos, un dominio limitado del inglés o ciertas condiciones de salud, entre otras. Si se aprueba, esto podría considerarse seriamente cuando se deniega a una persona una tarjeta verde. Es importante que la comunidad sepa que esta regla aún no se ha adoptado o está vigente. En este momento, tenemos la oportunidad de luchar contra él. Instamos a los miembros de la comunidad inmigrante, organizaciones, empresas, funcionarios electos y aliados a enviar comentarios públicos antes del 10 de diciembre que se opongan a esta regla propuesta."

Services, Immigrant Rights, and Education Network (SIREN) Condemns Trump Proposal on Public Charge and Prepares to Submit Public Comment 

Over the weekend, the Department of Homeland Security (DHS) announced its proposal to drastically limit the ability for low-income immigrants to get a green card. The new proposed rule would expand the definition of “public charge” to include non-cash public benefits for food and nutrition assistance, certain health care benefits, and housing and rental assistance. The use of these benefits moving forward could be heavily factored into denying an individual a green card. It is important to note that this rule has not yet gone into effect and immigrants who are currently eligible for those programs can continue to use them. It would not apply to certain categories of individuals, including refugees, asylees, and survivors of domestic violence, seeking a green card.

The following is a statement from Maricela Gutiérrez, Executive Director of Services, Immigrant Rights, and Education Network (SIREN):

“The expansion of public charge is clearly designed to punish communities of color who rely upon these safety net resources to survive. If this rule were adopted, working class immigrants and their families could be denied the opportunity to get a green card simply because they need to put food on their table, a roof over their head, or get life-saving health care. Health, food, and housing are basic human rights and no one needs to choose between these basic needs and being reunited with their family. This proposed rule is yet another attack on immigrants and their families orchestrated by Trump and the xenophobic forces within his Administration. This rule is not yet in effect and we have the opportunity to fight it - which is exactly what SIREN will be doing to ensure that everyone has a chance to get a green card, regardless of where they come from or how much money they make.”

After the final proposed rule is released, SIREN will join partners across the country urging community members and allies to submit public comment demanding that the definition of public charge not be expanded.

Esta regla propuesta es otro ataque a los inmigrantes y sus familias orquestado por Trump y las fuerzas xenófobas dentro de su administración. Esta regla aún no está en vigencia y tenemos la oportunidad de luchar contra ella, que es exactamente lo que SIREN hará para garantizar que todos tengan la oportunidad de obtener una tarjeta verde, independientemente de dónde vengan o cuánto dinero ganen. "

Después de que se publique la regla final propuesta, SIREN se unirá a socios en todo el país para instar a los miembros de la comunidad y a sus aliados a enviar comentarios públicos exigiendo que no se amplíe la definición de carga pública.
